The topic of ‘Do we need bans or commandments?’, which I announced in the last column, is a difficult one. Everyone will agree with the commandment ‘Thou shalt not kill’, but not with the ban on serving alcohol in public swimming pools. What is the difference? One is certainly that the above-mentioned commandment protects everyone's right to life, whereas the ban does not. Ultimately, it is therefore a question of making regulations that protect recognised legal interests and/or do more good than harm. Sometimes this is very clear, e.g. when the law says that you must drive on the right-hand (or the left-hand naturally)side of the road. This requirement is very useful if you imagine that it does not exist and everyone can drive as they please. But sometimes it's not so clear, for example when the law says I have to wear a seatbelt in the car. So I am forced to do something that only benefits me. Is that the case? More on this in the next column.
